Technical University of Delft (hereinafter: TU Delft) intends to grant a long-term ground lease for a period of 99 years, including the establishment of a right of superficies, to Stichting Studentenhuisvesting DUWO (hereinafter: DUWO) with respect to a parcel of land registered in the cadastral records of the Municipality of Delft, Section K, number 4053 [partially], located on Mekelweg in Delft, with an area of approximately 6,000 m². A student housing complex comprising approximately 600–800 student units will be realized on the aforementioned parcel.
Within the Municipality of Delft, there is currently a significant shortage of student accommodation for both national and international students. In light of this shortage, TU Delft has an interest in contributing to the provision of sufficient affordable student housing within the municipality. By granting the land under a long-term ground lease, TU Delft will contribute to the realization of student housing within the first rent allowance threshold. These dwellings will be permanently operated as such.
TU Delft intends to grant the aforementioned parcel under a long-term ground lease to DUWO. DUWO is an authorized housing association within the meaning of the Dutch Housing Act and focuses specifically on affordable, social student housing. On the basis of statutory provisions, DUWO is therefore able to provide long-term security regarding the availability and affordability of the dwellings. The units will be let in accordance with the Housing Valuation System (Woningwaarderingsstelsel, hereinafter: WWS). Further arrangements, such as the application of the WWS and the applicable rent allowance thresholds, will be laid down in the intended ground lease agreement and will be safeguarded by DUWO throughout the entire term of operation.
Between the Municipality of Delft, the authorized housing associations Stedelink, Woonbron, Vidomes, DUWO, and relevant stakeholder organizations, performance agreements were concluded for the period 2024–2031 in a cooperation agreement dated 12 December 2024, in order to implement the Housing Vision Delft 2023–2028. With regard to student housing, the agreement includes the ambition to add 3,500 student housing units within the municipal boundaries of Delft during the period 2021–2030. These units are to be realized preferably by a housing corporation, in this case DUWO (on the basis of the agreed performance arrangements).
The first three aforementioned housing associations have confirmed in writing that they have no interest in developing this parcel. In the cooperation agreement concerning the performance arrangements, as included in Annex 1: Housing Corporation Project Pipeline, the development of the student housing on Campus Midden has already been included as a project designated for DUWO. In view of the above, TU Delft is of the opinion that, based on objective, reasonable, and verifiable criteria, DUWO is the only serious candidate eligible for the establishment of the long-term ground lease and the dependent right of superficies on the parcel referred to above.
Objection period
If you do not agree with this intended decision, you must notify TU Delft within 20 calendar days after the date of publication by submitting a reasoned response by e-mail to omgevingsmanagement-crefm@tudelft.nl, stating:
“Response to intended grant of long-term ground lease by TU Delft to DUWO (date: 27 October 2025)”.
Upon receipt of a reasoned response, TU Delft will provide a substantiated reply within a reasonable period of time. If you subsequently do not agree with this reply, you may initiate summary proceedings before the District Court of The Hague within 7 calendar days. If you fail to make use of one or both of these time limits, your right to legally challenge the intended grant of the long-term ground lease will lapse, and the land will be granted under a long-term ground lease to DUWO.
